Remember the Brave With Memorial Day Events

Memorial Day is the last Monday of May each year and is the official start of the summer season. Memorial Day events usually consist of barbeques and picnics as this is a family celebration day. There are special events that take place in cities across the United States to honor Memorial Day, a day where those who have fallen in defense of the nation are honored.

Washington, DC

Memorial Day events that take place throughout Washington DC are more somber as they include a visit to the tomb of the Unknown Soldier. This is not so much a day for partying in Washington, DC, but one of reflection. There is a special presentation at the Lincoln Memorial on this day. Flags are often distributed to the population on this day and put in cemeteries.

New York City Memorial Day Events

Memorial Day in New York City is the start of the summer in Central Park. Central Park is open all year long, but this is the weekend when it really comes alive after a winter of hibernating. The Central Park Memorial Day fest is one of the biggest events for this city and features foods from restaurants located throughout the city, all in the park. This event takes place the week leading up to Memorial Day and ends the day after Memorial Day. Anyone who wants to taste the different foods of the New York restaurants can do so when visiting Central Park for the Memorial Day fest.

San Francisco Memorial Day Events

The weather in San Francisco is mild most of the year and Memorial Day events take place throughout the city to start the summer season off. The Art Festival is one of the biggest Memorial Day events in this city and features art of all types being shown on streets and in galleries. Art critics converge on San Francisco each Memorial Day weekend to enjoy the art and perhaps discover new art talent. The art show each year in San Francisco is open to anyone, but artists must register to display their work ahead of time with the Chamber of Commerce.

Chicago Memorial Day Events

Fireworks off of Navy Pier signify the start of the Memorial Day weekend in Chicago. In addition to the fireworks that hail the unofficial start of summer in Chicago, Grant Park is alive with music. The Annual Blues Fest is one of the Memorial Day events that take place each year in the city of Chicago. Both Navy Pier and Grant Park come alive for this day, with fireworks and music celebrations. The traditional turning on of Buckingham Fountain also takes place on Memorial Day each year.

Memorial Day is a day for remembrance and is a national holiday in the United States. The weekend that leads up to Memorial Day is considered the first weekend of the summer season, with the close of the summer season being the weekend of Labor Day. Although officially summer does not start for another month after Memorial Day, this day is the unofficial start and Memorial Day events set off the first of many summer festivals and events in cities across the United States.

Blind artist, Bojana Coklyat, inspires with her incredidle life story and stunning art

Bojana’s thought provoking artwork has taken her all the way to the White House, and her inspirational life story and charity work with local young artists continues to propel her to the next level. Raised in Jersey City, Bojana Coklyat graduated from McNair Academic High School and went on to attend The School of the Art Institute of Chicago. After returning from college she began participating in art shows in the Jersey City and New York area, finally creating her own grassroots artist collective called “A Show Grows”. Toward the end of the third successful show, complications from her Diabetes started to arise such as a fractured foot, kidney failure and Diabetic retinopathy, which led her to be legally blind. This basically means you are looking through a foggy windshield that cannot be cleared up with any kind of glasses. Regular print, details on faces cracks and in the street are all a blur.

For almost a year Bojana had begun the process of isolating herself and most despairing of all had stopped painting altogether. Shortly after moving in with her brother she found The New Jersey Foundation for the Blind in Denville. On a whim she decided to take the art therapy class, not expecteing to gain any new artistic insights. However, this class brought back her creative urge and the other thriving students also inspired her. The experience at the school helped her adjust to her vision loss and dive into a whole new world of artistic possibilites. This included painting an ornament for the 2008 White House Christmas, tree as well as visiting Washington DC for the reception in honor of the other artists chosen from the 50 states. During this time Bojana was also a volunteer at The New Jersey Foundation for the Blind with the art therapy program. Later on she also began volunteering at St. Josephs School for the Blind in Jersey City. At the time they did not have an art teacher on staff, so she volunteered for the position. After a year and a half of creating projects tailored to each student’s needs, she was officially hired as the new art teacher. This on top of being awarded a citation for “public service” by Hudson County Cultural Affairs has made it a very good year for her!

On November 17th, 2011 Bojana received a kidney and pancreas transplant. The transplant was very successful and in her doctor’s words,”she is doing phenomenal.”. Now having more time which is not taken up with dialysis, constantly checking blood sugar and taking several insulin shots a day, she has burst back onto the art scene at full speed! Since her three months of restriction from going out in public due to her suppressed immune system, she has had five new art shows scheduled. With her new found energy she has been able to do more with the community, reach larger numbers of people with her art, and of course create tons of new and exciting art pieces. Shortly after her recovery period News 12′s “On the Scene” reporter John Bathke came to do a follow up interview to the one he did after Bojana had gone to the White House. Bojana has two big events coming up, one in April and one in May. The first one involves her giving a speech and exhibiting her art at NJCU for their People’s With Disabilities Month celebration. The second is an art exhibit for her students from St. Joseph’s School for the Blind, in collaboration with Hudson County Cultural Affairs.

Co-owner, Frank Cupo, of La Guardiola pizza restaurant in Bayonne, NJ, where one of Bojana’s murals is displayed says of the piece, “Bojana’s artwork always gets a lot of attention and comments in our restaurant. Sometimes people come here just to see her artwork or they heard about it from a friend or neighbor. It draws people in from the outside and fascinates with its uniqueness. I have great respect for her as an artist and I know she will go far because she is a great talent.”

Her next challenges include completing another mural in Bayonne and one in Jersey City, as well as getting a kidney transplant, which she is hoping to get after she has finished the murals! All these health issues affect Bojana’s artwork in some dark ways, but also in some insightful ways. Bojana says, “Through all of this I’ve learned there is always a way to find hope and to turn the light on in the dark, you just have to find the switch.”

Bojana graciously took the time to answer some of our questions about her health, art and charity work.

What advice would you give to someone with diabetes?

What I found has helped me most with any of these “struggles” is my family and friends. I’d say keep them close, talk to them about how you are feeling and this may sound strange but practice patience with them. In my experience and with many others I have spoken to, loved ones tend to want to do everything for you, or they fear constantly for your safety. Do not lose who you are, your independence and strength because you are afraid or your family is afraid. My advice is it’s better to learn to get to the grocery store alone, than to never feel like you have the strength to depend on yourself. There are so many organizations, support groups and other people in a similar situations who can help you retain this very important element.

Also, take what life has given you and make the best of it. You can mold your life however you want. It just takes hard work and time. If you have the will to do it and you believe in yourself other people will respond to that. People may not understand how you could do a certain thing because you have a disability, but then you can show them. How many times do you think I’ve heard, “How can you paint if you are legally blind?”

How can a young artist find their style, or niche, and what organizations would you recommend that helped you with your art career?

To find your style in whatever medium it is, you have to do, do, do! Paint, draw or sculpt everyday until what you do is a part of your personality. With time you won’t have to worry about the technical aspects and you can just focus on what you want to express. Go to museums, galleries and “do it yourself” artshows to gain inspiration from other artists who interest you.

For young artists, find out about art programs in your school. I started in the ATC program at P.S. 6 here in Jesey City and went on to participate in the VPA high school program connected with NJCU. The New Jersey Foundation for the Blind has an amazing art program for adults who are visually impaired or blind. I don’t know where I would be without that organization! They have given me a great deal of support and inspiration. The number of organizations in New Jersey for young artists is amazing, but don’t forget to also learn from your friends and family! There is inspiration everywhere. Maybe your mom has a painting in the attic or uncle Nick likes to draw in his spare time. So ask them how they do things and learn how they got inspired.

You mentioned a new direction in your art. Can you give us an idea of what we can expect.

Most of my work has some kind of text in it, but these newer pieces contain a lot more layered text. What I write starts off small and in script, then I put a larger layer on top of that. Finally I have taken a large brush and slapped a couple words from my initial thought on the piece. The images that I’m using have a painted, thick scar running down their torso, representing my kidney/pancreas transplant. I think there is still a lot of developing left to go but the work will always be communicative, intimate and expressive.

What have you been up to lately in your career and how is your recovery coming along?

I had to wait for three months after the transplant to be able to mingle with the public because of my suppressed immune system. Febuary was the last month of my quarentine and in March I participated in five group shows in spaces like Shampoo JC, Jersey City City Hall, Arthouse Productions, Rotating Galleries and LITM. Coming up on April 19th I will be exhibiting and auctioning artwork for the American Conference on Diversity at NJCU. The next day I will be presenting a speech and showing my art for NJCU’s Peoples With Disabilities Month event. Also coming up shortly News 12 New Jersey’s “On the Scene” will be airing an interview with me, so you can check my blog at bojanacoklyat.blogspot.com for that! On May 24th there will also be a show featuring the artwork of my students from St. Joseph’s School for the Blind at The Brennan Courthouse in Jersey City.

Suffice to say, the recovery is going really well! I have more energy than ever and I just have a feeling that anything is possible. My doctors at St. Barnibus have been so amazing and supportive, not to mention the nurses and other staff as well! They are very happy with how I am recovering and I plan to keep it that way!

You are very inspirational. Do you plan on speaking to young people about your experiences and giving them advice about maintaining health or pursuing their art?

At The New Jersey Foundation for the Blind I have spoken many times to varying groups including high school students. I also had a chance to speak to some high school volunteers at St. Joseph’s School for the Blind. I didn’t speak specifically about art or health, but I told my story and I can only hope they took from my advice is that you should take care of yourself and follow your dreams whatever they are.

In my classes, and in my everyday life, I encourage people to pay attention to their health and keep their creative spirits alive.

On April 20th at NJCU I will be speaking to a crowd including college students and my message will be in part about going after what you want whether it is art or otherwise. If the opportunity came along to speak more directly to young people about their health or art I would definitely be inspired to do so!

What are some of your favorite new healthly recipes or health food products?

Well I discovered a red pepper hummus recipe which is nice because you have the protein from the chic peas and the antioxidents from the roasted red peppers. Ingredients include:

two 16oz cans of chic peas

1 juice from a whole lemon

2 cloves of garlic

1/4 a cup roasted red peppers

2 tblsp of tomato paste

2 tblsp olive oil

2 tblsp tahini

1 tspn red pepper flakes

salt and pepper to taste

Drain the liquid from the chic peas and then throw the chic peas in a blender. Combine all the ingredients and blend until smooth. You may need to add more tahini or olive oil depending on how you like it!

Also, I have found Special K protein bars are really great for a quick snack that holds me over until I can have lunch or dinner. I love the peanut butter ones the best!

How to Engage on Twitter

Twitter rules of engagement, although these may sound way too formal to those people who are active participants in the microblogging platform of Twitter, do exist.

First, Twitter is much easier to join than, for example, Facebook or LinkedIn because you can have a fully realized Twitter profile in moments as compared to the much more extensive information needed for a Facebook or LinkedIn profile to be fully realized.

Second, Twitter has perhaps less formal rules than many other social networking sites because you can follow anyone without asking permission as, for example, you must do on Facebook to friend someone or on LinkedIn to connect with someone.

Yet the true Twitter rules of engagement – the ones that make using Twitter so effective for promoting your business – are often the unwritten ones that you either glean from observing what others do or from reading blog posts and articles about effective Twitter use.

Here are my own recommendations for the 7 best rules of engagement on Twitter:

1. Your mindset should be on sharing valuable information first and promoting your own business second. This is how people get to know, like and trust you – and then possibly do business with you.

2. You should commit to being an active Twitter participant – posting one tweet every week or every other week does not indicate an active participant. While many active Twitter users take the weekends off, you can tell an active participant by whether he/she has several tweets in the current week.

3. You should try to answer questions to which you know the answers and can provide helpful information. For example, if you live in Chicago and someone tweets asking for a good Italian restaurant in the city, then provide a recommendation if you can.

4. It’s a good idea to respond if someone replies to you. It’s not necessary to tweet “you’re welcome” if someone replies “thank you”.” But if someone replies “Could you give me the link to the article to which you referred?” – do reply with the link to that article.

5. Switch a public conversation to exchanging DMs (direct messages) when it is clear that other people aren’t interested in what you and one other person are exchanging tweets about. FYI – Sometimes a private conversation follows from a public conversation. There are times a particular conversation should be private from the beginning.

6. When you tweet with a recommendation for an article or blog post, include the link to that article or blog post. FYI – It is very annoying to read a tweet about an interesting-sounding article or blog post and have no link to what is being talked about.

7. Tweet thanks to people for tweeting or retweeting links to your projects – this is simply good manners. And when you do so, include the link that was in the person’s tweet or retweet so that other people reading your thanks can click on the referred-to link.

To sum up the overall Twitter rules of engagement, with your mindset of sharing information – be polite, helpful and engaged in the community.

Overwhelmed by Online Dating? Find the Right Matchmaking Service in Seattle

Dating services are a popular way to get out there in the dating scene, but there are so many to choose from. Also, they often vary in their matchmaking strategies, price, and commitment required. So how do you choose?

I am going to rule out online dating sites, because there are too many and they all offer similar services. They can be useful, but we all know they have an overwhelming number of misleading profiles. I have seen profile pictures of Brooke Burke up there- no kidding. You know there are too many options when you narrow your search down to only brunettes under 5’ 9” and still get thousands of results. Online dating, unfortunately for those who do it honestly, is just full of strange people with great profiles.

So let’s assume you want more tailored matchmaking. You also want more care taken to protect your privacy and set you up with desirable candidates. This means you will want to use a “boutique” service. These companies often offer many personalized services and more attention to you, the client. The most expensive of these services often try to do all the work for the client by finding dates and handpicking every detail. Who wants to go on a date with someone who is too inept or lazy to choose the restaurant?

One good way to evaluate a boutique service is to see how much personal attention you receive. You want the option of getting lots of individualized attention and advice, but choose a service that stops short of doing everything for you. How will you learn that way? Ideally, you will acquire skills and not become reliant on a service for all your social needs.

With many services, (and the user reviews back this up) you will get “personal” attention from a salesperson working for commission, who will disappear as soon as you sign up, never to be seen again. Just a quick Google search for “feedback” or “reviews” of many popular companies will reveal this to be, unfortunately, widespread. Choose a service with a good national and local reputation. If there are negative reviews for a service’s Chicago branch, it can mean that the business model will be just as flawed in the Seattle franchise as well.

Long story short, make sure that a dating company will meet with you regularly to discuss your concerns and progress, and see that they will actually use your feedback to set you up with better matches. For those services with contracts, after you sign on the dotted line and pay a huge fee, are they going to hold up their end of the bargain? Be especially wary of any service that asks you to sign a contract before attending one of their events. It may sound cynical, but many services don’t care who they set you up with or how happy you are with your “matches” after already have your credit card information. Services that charge monthly are more likely to keep your interests in mind.

A newer trend in boutique matchmaking services is to offer dating advice, classes and coaching to members. These companies will assist the member along the way in their search for a long-term relationship. For example, “social matchmaking” with Guys And Girls Next Door in Seattle offers courses taught by experts in their fields, as well as individualized counseling with a staff psychologist and drop-in hours for members to ask questions and receive advice. They even offer fashion advice! This service sets up members on group dates, so they can meet lots of people, make friends, and maybe find a relationship match, all while enjoying fun events. Finally, consider the types of events that you will be going to with the service. Dating services that offer fun, group events can be more likely to result in friendships and long-term relationships than all-or-nothing blind dates. This type of matchmaking is sometimes called social matchmaking.

Condotels Meet Investors’ Business and Leisure Objectives

What could be better than owning a vacation home and earning rentals when you aren’t using it? Until recently, John Thomas with his Filipina wife from London, UK, owned a traditional vacation home, in Metro Manila, Philippines. But after a year away from the country — they arrived during the summer holidays to find the tenants that were renting the property had run away leaving the property abandoned and his caretaker, whom was no longer to be found, had pocketed the rent — he sold the house and bought two condo hotel units instead.

Now, Mr. Thomas and his family own Condotel Suites in Manila and Cebu, and expect to earn money when the rooms they own are rented out to other guests. Mr. Thomas, his wife April and their seven year-old daughter are planning to spend their 2007 Summer Vacation in their unit at the Lancaster Suites in Manila, Philippines, a 450-unit Condo Hotel built and managed by Pacific Concord Properties Inc under the Lancaster brand of Hotels.

Mr. Thomas says. “If Lancaster rents out the unit during 11 months of the year, I’ll make enough money to take my family on a second trip to the Philippines during the Christmas Holidays and go a long way to covering the mortgage payments”

Expectations like Thomas’s are driving the market for Condotels — condominiums you buy that can be rented out as hotel space — to new heights in the Philippines.

Owners of Lancaster Condotel units can arrange to stay in their units and they share 60% of any rental income. The Lancaster Atrium together with the soon completed Lancaster Suites Manila, one of the hottest real estate investments in the Philippines, will be the hub for Lancaster Condotels. The 42-story Lancaster Suites Manila, scheduled for operations next year, will feature studio, one-bedroom and two-bedroom Condotel units, as well as penthouse suites. The units will be available for daily, weekly or monthly rental, Collingz said.

“Lancaster Atrium is going to have a property manager and will be operated as a four-star hotel.” The Condotel development will include the Lancaster mini mall with grocery and convenience stores, retail center, restaurants, business center, a private exclusive members only Businessman’s Club and spa on the site, she said. Prices range around 150 per square foot on up to 250 a square foot. Construction already commenced on the Atrium project, excavations, foundations, sub basements, 5-levels of basement parking and the lower ground floors are already in place. Construction of the superstructure will commence next year for completion from December 2009. Lancaster – The Atrium is also located in Shaw Boulevard, Metro Manila, Philippines, adjacent to the nearly complete Lancaster Suites.

Several new Condotel projects also are in the works on the other side of the country. Collingz said that a major condo hotel project is being considered by the Company with several investors in Cebu, Philippines next year. “We’ve got so many clients requesting for Luxury Condotel Suites in Cebu and other areas in the country,” she said. “It’s like a whole new era of Overseas Investments that are coming up — it’s not something that we’ve typically seen in the past. (These Investors) are all characteristically looking for a five star hotel resort, with all the features of a hotel that can be used for vacations and then rent out the units when not in use”.

There are new and exciting luxury five-star properties or high end developments planned in Cebu Philippines next year that will be sold by invitation only and may start in the 150,000 to 200,000 dollar range, but can go all the way up to 600,000 dollars for 2 bedroom Penthouse suites and 800,000 dollars for a Grand Penthouse. Of course, International gateways from Europe, South East Asian and the United States to Cebu-Mactan International Airport is within 10 minutes and, all units have sea views, beach toys and other lifestyle amenities such as spa and fine dining restaurants and will come fully furnished and finished to the highest European or US standards with fully fitted kitchens, fitted bedroom suites and every unit will be sold including all appliances, split type central unit air-conditioning, plasma TVs’ and state of the art condotel management systems. Units will be significantly larger in size than a typical hotel room yet still a much better value for money investment option than paying 800,000 dollars for a studio suite in maybe Dubai or Panama or a cool million dollars for a condo in Chicago.

2011 Employment Law Update

New Poster Requirements:

There are new 2011 versions of the following required federal posters: “Federal Minimum Wage,” “Equal Employment Opportunity is the Law,” and “Safety and Health Protection on the Job.”

There are also new 2011 versions of the following California required posters: “California Minimum Wage,” “Your Rights Under USERRA (Veterans Benefits),” and “Notice Employee Polygraph Protection Act” posters.

In addition to the above, in 2011, employers using Managed Professional Networks (MPNs) to provide treatment for workers’ compensation claims must post information informing employees about the MPNs being used. Any pamphlet distributed by the employer regarding workers’ compensation must also include information regarding the employer’s MPNs.

California

Amendment to California’s FAIR EMPLOYMENT AND HOUSING ACT (AB 1814): California Government Code § 12940 has been modified at subdivision (a)(5)(B) to specify that an employer is not liable for age discrimination if the employer alters, reduces, or eliminates health benefits or health care reimbursement plans to retired persons when the retirees become eligible for Medicare benefits at age 65.
Certain Union Employees Exempt from MEAL PERIOD REQUIREMENTS (AB 569): California Labor Code § 512 has been amended to exempt from meal period requirements employees in construction occupations, commercial drivers, employees in the security services industry employed as security officers, and employees of electrical and gas corporations or local publicly owned electrical utilities, but only if (a) the employee is covered by a valid collective bargaining agreement; and (b) the agreement expressly provides for the wages, hours of work, and working conditions of the employee, including meal periods, premium wage rates for all overtime hours worked, and a regular rate of pay not less than 30% more than the state minimum wage rate.
EXPEDITED JURY TRIALS ACT (AB 2284): This act creates procedures for expedited jury trials in civil cases where the parties stipulate in writing to the new procedures.� Trials have eight instead of 12 jurors, with no alternates.
A vote of six jurors is required for a verdict.
Peremptory challenges are limited to three (instead of six).
Each side must present its case in three hours.
Parties waive their rights to an appeal or to move for a directed verdict.
Parties agree that the expedited jury trial is binding, subject to any written high/low agreement (a written agreement may be entered into by the parties that specifies a minimum amount of damages that a plaintiff is guaranteed to receive from the defendant, and a maximum amount of damages that the defendant will be liable for, regardless of the ultimate verdict returned by the jury.)

UNEMPLOYMENT INSURANCE ELIGIBILITY FOR DOMESTIC VIOLENCE VICTIMS (AB 2364): Prior California law allowed employees to retain their eligibility for unemployment if they left employment to protect their children from domestic violence abuse. The new law specifies that employees retain their eligibility for unemployment if they left employment to protect their family from domestic violence abuse.
PAID LEAVE ENTITLEMENT FOR ORGAN AND BONE MARROW DONATIONS (SB 1304): California Labor Code §§ 1508-1513 extends a benefit previously only held by State employees to private employees as follows:� Private employers with 15 or more employees must provide up to 30 days of paid leave per year for an organ donation to another person in any one-year period and up to five days of paid leave per year for a bone marrow donation to another person in any one-year period.
Such leave is not considered a break in service.
Such leave shall not be taken concurrently with FMLA or CFRA leaves.
Employers may require an employee to take up to five days of accrued sick or vacation leave for bone marrow donations and up to two weeks of accrued sick or vacation leave for organ donations, unless prohibited by a collective bargaining agreement.
Employers must restore the employee to the same or an equivalent position upon the employee’s return to work.

Martinez v. Combs (2010) 49 Cal.4th 35. The California Supreme Court clarified the definition of “employer” under California Labor Code § 1194 to be that set forth in the IWC’s wage orders, not the common law, as follows:� Party who exercises control over the wages, hours or working conditions; or
Party who suffers or permits work; or
Party who “engages” under the common law definition.
Key test: whether a party has the power to prevent an employee from working by being involved in hiring, firing, or setting and/or paying wages.
The Court disapproved the “down-stream” benefit theory, which set forth that a party should be found to be an employer if it knew of a person’s employment and benefited from it.

Reid v. Google, Inc. (2010) 50 Cal.4th 512. The Supreme Court rejected the “stray remarks” doctrine’s “categorical exclusion of evidence” and determined that the ageist remarks could be considered to determine if the stated reasons for termination were pretextual. The stray marks themselves may not suffice as proof that discrimination occurred, but may be probative of discriminatory animus when considered with other evidence.
Pineda v. Bank of America, N.A. (2010) 50 Cal.4th 1389: California Labor Code § 203 provides, in pertinent part, that “if an employer willfully fails to pay, without abatement or reduction, in accordance with Sections 201, 201.3, 201.5, 202, and 205.5, any wages of an employee who is discharged or who quits, the wages of the employee shall continue as a penalty from the due date thereof at the same rate until paid or until an action therefor is commenced …” for up to thirty days.
Plaintiff was belatedly paid his final wages before filing suit and filed to recover only the penalties for the late payment.
Two lower courts held that plaintiff’s actions were barred by a one-year statute of limitations. The California Supreme Court disagreed. It held that a different statute of limitations does not apply when an employee seeks to recover only Labor Code § 203 penalties. Section 203, subdivision (b), contains a single, three-year limitations period governing all actions for § 203 penalties irrespective of whether an employee’s claim for penalties is accompanied by a claim for final wages.

Pearson Dental Supplies, Inc. v. Superior Court (2010) 48 Cal.4th 665. If an arbitrator makes an error of law which prevents an employee from obtaining a hearing on the merits, the arbitrator has exceeded his/her powers within the meaning of Code of Civil Procedure § 1286.2, subdivision (a)(4), and a court may set the arbitration aside.
Lu v. Hawaiian Gardens Casino, Inc. (2010) 50 Cal.4th 592.� Although Labor Code § 351 provides that tips are the “sole property” of the employees who receive them, it does not create a private cause of action for employees who believe their tips have been misappropriated by their employer. Only the Department of Industrial Relations may enforce Labor Code § 351′s provisions.
Although section 351 does not create a private right of action, an employee may have other remedies if gratuities are misappropriated, such as a common law action for conversion.
The Court declined to rule on whether tip pooling arrangements are permissible under section 351.

Bright v. 99¢ Only Stores (2010) 189 Cal. App. 4th 1472. Penalties under the Private Attorneys General Act (“PAGA”) are available for violations of Section 14 of the California Industrial Welfare Commission Wage Order 7-2001, which requires employers to provide employees with “suitable seats when the nature of the work reasonably permits the use of seats.”
Any penalties awarded under PAGA are split between the aggrieved employees (who get 25%) and the California Labor and Workforce Development Agency (who gets 75%). Employees can also recover their attorneys’ fees.
Although the appellate court agreed with the lower court that the Wage Order did not provide a penalty applicable to seating violations on its face, it ruled that violations of Wage Order 7 also amount to violations of Labor Code § 1198, which makes it unlawful to employ workers under conditions of labor prohibited by a wage order, such as failure to provide seating. Because section 1198 does not specify a civil penalty, PAGA both supplies a civil penalty and allows aggrieved employees to sue to recover it.

Federal

FORM I-9: The United States Department of Labor has issued a final ruling on electronic signatures and storage of Forms I-9. Employers may complete, sign, scan and store Forms I-9 electronically.
The Form I-9 must be completed by the third business day after an employee has started work.
Employers may store forms either in paper form, electronically, or through a combination of both.
Employers may, but are not required to, provide Form I-9 transaction conformations if requested by an employee.

The EEOC issued regulations on how the GENETIC INFORMATION NONDISCRIMINATION ACT (“GINA”) is going to be administered.� “Genetic information” is defined as any information about (1) an individual’s genetic tests; (2) the genetic tests of the individual’s family members; and (3) the manifestation of a disease or disorder in a family member.
There is no definition for a “genetic test.” Guidance is given by way of example. The following are NOT considered to be genetic tests: complete blood counts, newborn screening tests, amniocentesis, cholesterol tests, liver-function tests, or tests for the presence of alcohol or illegal drugs.
It is illegal for employers to receive protected information, unless such receipt is “inadvertent.” An employer’s receipt of protected information will not be considered “inadvertent” unless the employer has affirmatively directed the employee not to provide genetic information when responding to an otherwise lawful request for medical information. Therefore, all FMLA and CFRA forms MUST be updated to direct an employee not to provide genetic information.

NEW FEDERAL WHISTLEBLOWER PROTECTIONS: Dodd-Frank Wall Street Reform and Consumer Protection Act (“DFA”) (H.R. 4173). The DFA creates new whistleblower protections and expands existing protections for employees in the financial services industry. The DFA: Prohibits retaliation against individuals who provide information to the SEC, initiate or participate in SEC administrative actions, or make disclosures required by or protected by laws and rules under the SEC’s jurisdiction.
Includes an incentive program to encourage reporting of SEC violations.
Creates a civil cause of action in Federal Courts, with a six-year statute of limitations.
Limits use of mandatory pre-dispute arbitration agreements/releases of whistleblower claims.

Lewis v. City of Chicago (2010) 560 U.S. ____, 130 S.Ct. 2191 (2010). The statute of limitations for filing a disparate impact charge of discrimination with the EEOC over an allegedly discriminatory employment practice restarts each time the employer engages in that practice.
City of Ontario v. Quon, 560 U.S. ____, 130 S.Ct. 2619 (2010). The United States Supreme Court held that the City of Ontario did not violate an employee’s privacy rights by reading his non-work hour text messages, because the search was justified, the search method was reasonably related to the search’s objectives, and the methods were not excessively intrusive. The Court declined to determine whether an employee has a reasonable expectation of privacy in personal text messages sent from an employer-issued pager.
The Court decided to assume that Quon had a reasonable expectation of privacy in the text messages and then determined that the subsequent search which led to the discovery of the text messages was reasonable under the Fourth Amendment, because “[t]he judiciary risks error by elaborating too fully on the Fourth Amendment implications of emerging technology before its role in society has become clear.”�

Hertz Corp. v. Friend, 560 U.S. ____, 130 S. Ct. 1181 (2010): The United States Supreme Court adopted the “nerve center” test for corporate citizenship, helping to clarify when multi-state companies may remove lawsuits to Federal court. The “nerve center” is “the place where a corporation’s high level officers direct, control and coordinate the corporation’s activities, … which will typically be found at its corporate headquarters.”
Rutti v. Lojack Corp., 596 F.3d 1046 (9th Cir. 2010): On March 2, 2010, the Ninth Circuit issued a revised opinion which superseded and changed the holding in its August 21, 2009 decision. The issue decided was whether commute time is compensable under California law, Labor Code § 510. The court concluded that, although commute time is generally not compensable under Labor Code § 510, it may be compensable where employees are so restricted in their activities to be considered under the control of the employer. Factors the court considered were: Whether the employee may take passengers in the vehicle during his or her commute time;
Whether the employee may stop for personal errands or is required to drive only to and from his or her home and the worksite;
Whether the employee may use his or her cell phone during the commute except to take calls from the employer; and
Whether the employer dictates the employee’s first assignment of the day and the order in which the employee is to complete the day’s jobs.

EEOC v. Prospect Airport Servs., 621 F.3d 991 (9th Cir. 2010): Title VII protects both genders from being sexually harassed at work.
Mayo Foundation for Medical Education and Research v. United States (Docket No. US 09-837 January 11, 2011). Medical residents are full-time employees not exempt from payroll taxes.
Dawson v. Entek International, Docket No. 09-35844 (9th Cir. 2011). Plaintiff Shane Dawson is a male homosexual who brought claims of retaliatory discharge, sex hostile work environment, and sexual orientation hostile work environment upon being terminated from employment. The trial court applied the McDonnell Douglas Corp. v. Green burden shifting framework to analyze the claims. The Court of Appeals held as follows: The trial court was correct to apply the McDonnell Douglas burden-shifting scheme when determining if the court should grant summary judgment to the employer.
However, the trial court erred when it concluded that Dawson did not offer any evidence of pretext to rebut the employer’s proffered legitimate reason for terminating Dawson. The court found there was circumstantial evidence such that if believed by a trier of fact, Dawson could prevail. Further, the court found that there was no legal precedent to support the employer’s assertion that a probationary or temporary employee is subject to a different or lower standard.
The court found that the trial court did not err when it dismissed Dawson’s claim for IIED, because “[i]n the corporate context, a company’s indifference to coworker harassment does not make out an IIED claim against the company.”

Pending Cases:

Sonic-Calabasas A, Inc. v. Moreno (2009) 174 Cal.App.4th 546, review granted, 99 Cal.Rptr.3d 866 (2009). (1) Can a mandatory employment arbitration agreement be enforced prior to the conclusion of an administrative proceeding conducted by the Labor Commissioner concerning an employee’s statutory wage claim?
(2) Was the Labor Commissioner’s jurisdiction over the employee’s statutory wage claim divested by the Federal Arbitration Act?

Harris v. City of Santa Monica (2010) 181 Cal.App.4th 1094, review granted, 108 Cal.Rptr.3d 555 (2010). Does the “mixed-motive” defense apply to employment discrimination claims under FEHA?

Brinker Restaurant Corp. v. Superior Court (Hohnbaum) (2008) 80 Cal.Rptr.3d 781, review granted, 85 Cal.Rptr.3d 688 (2008) (consolidated with Brinkley v. Public Storage, Inc.) Case addresses whether to “provide” a meal break means the employer must ensure the break is taken or simply has to make the break available and whether “early lunching” is permissible.
